Sale is conducted by the Fayette County Assessment Office.

Note:  This is not a tax sale; therefore the rules & regulations differ from those in the Tax Claim Bureau sales.

All announcements made the day of the sale supersede any printed materials distributed prior to the sale date.

About the sale

       Fayette County is offering for sale to the highest bidder various parcels of land acquired from the Fayette County Tax Claim Bureau via the Free & Clear process over the years.  The bidder should search the title himself for any liens or judgments that may not have been extinguished by the Tax Claim Bureau process.  The County will issue “Quit Claim” deeds to the successful bidder thirty (30) days after final approval of County.  All sales are subject to approval by the Fayette County Commissioners. 

       No title search was performed by the Assessment Office and the County makes no inference of good marketable title.

       No survey has been performed; depiction on tax maps may or may not be correct.  Not all streets depicted on tax maps exist and can be “paper right of ways”.  No inference of public utilities to the sites is made.  Potential buyers should research all aspects prior to placing a bid.

       Information displayed on the Assessment Office web site, www.fayetteproperty.org may be changed at any time to more accurately represent the subject parcels.  The County does not warranty the displayed information, photos, maps, etc.  The potential buyer should fully research all aspects of the property before making a bid.

       There is a minimum bid price of fifty dollars ($ 50.00) for each parcel.   It is noted that the County is required by law to have these properties appraised for liquidation purposes.  If the high bid the day of the sale does not equal the appraised valuation, the sale will not be approved, however the successful bidder will be given the opportunity to match the appraised value the county has determined and thus have the sale approved.  The additional payment will then be due at that time for the balance of the purchase price.

        Full payment must be made at the time of the sale.  Cash or Certified Check made payable to “Fayette County”.  If the sale is not approved by the Fayette County Commissioners a full refund will be issued to the bidder.  If the sale is approved by the County, then no refund will be made for any reason.

        Successful buyer is responsible for all recording fees to the Fayette County Recorder of Deeds Office as well as 2% transfer tax based upon the sale price. 

 The successful buyer shall also pay a twenty-five ($ 25.00) dollar deed preparation fee to the County at the time of bid.  All closings will occur in the Fayette County Assessment Office, 4th Floor, Court House at a predetermined time & date.  Successful buyer must record the deed that day.  Successful bidder must appear in person at the closing as no transactions will be conducted via mail.
